These Terms and Conditions apply to all purchases made by the Customer on the Website. Les Tapis Sauvages reserves the right to modify these Terms and Conditions at any time. However, the applicable Terms and Conditions are those in effect at the time the Customer places the order on the Website. The Customer acknowledges having read, at the time of placing the order, the specific terms of sale set forth herein and expressly declares to accept them without reservation. These general terms and conditions of sale govern the contractual relationship between Les Tapis Sauvages and its Customer, and both parties accept them without reservation. These general terms and conditions of sale shall prevail over any other terms and conditions appearing in any other document, unless otherwise agreed in advance, expressly and in writing.
1. ORDER
Les Tapis Sauvages confirms acceptance of the order to the Customer at the email address provided by the Customer. The sale will only be concluded upon confirmation of the order. Les Tapis Sauvages reserves the right to cancel any order from a customer with whom there is an existing dispute regarding payment for a previous order. The information provided by the buyer when placing the order is binding: in the event of an error in the recipient's contact information, the seller cannot be held responsible for any resulting inability to deliver the product.
2. PRODUCTS
Les Tapis Sauvages strives to provide the Customer with the necessary and essential characteristics of all products available on the website www.lestapissauvages.com. The products offered are those listed on the website www.lestapissauvages.com, subject to availability. Each product is presented on the website with a description outlining its main technical characteristics (dimensions, composition). The photographs taken by Les Tapis Sauvages of the products in its stock are intended to be as accurate as possible with regard to colors, materials, and tones. However, these photos are not contractual and do not constitute a guarantee by Les Tapis Sauvages.
3. DELIVERY
As these are unique pieces, all rugs for sale on the website www.lestapissauvages.com are in stock in Paris. The average order preparation time is 24 hours (excluding weekends).
Shipping costs are calculated based on the weight and dimensions of the package. Shipping is free for orders over €790 for Metropolitan France, €1390 for the European Union, and €1890 for the rest of the world. The different delivery rates according to geographical zones can be found in the "Deliveries" section of the website www.lestapissauvages.com.
Products are delivered worldwide to the postal address indicated by the Customer on the order form.
Orders are then entrusted to the carrier Chronopost (France and Europe), DHL, or FedEx (Rest of the World). Delivery times provided by the carrier are 48 hours but are not guaranteed; these times may be extended for reasons beyond the carrier's control.
Chronopost commits to delivering the products directly to the customer, against signature. The customer may also designate a secure location or a trusted person to whom the order can be left. The carrier and Les Tapis Sauvages are no longer liable once the package has been delivered.
If you are not home, a second delivery attempt will be scheduled by the carrier or, according to your instructions, the package will be left at the nearest post office/collection point.
The customer must verify the accuracy and completeness of the information provided to Les Tapis Sauvages. Les Tapis Sauvages cannot be held responsible for any delays or failure to deliver products due to incorrect data entry by the customer. The costs incurred for reshipping the order are entirely the responsibility of the Customer.
If the package appears damaged, open, or broken, the Customer must refuse delivery, expressly noting the condition of the package on the delivery slip. No refund will be issued if the package is damaged due to the Carrier's fault.
For deliveries outside the European Union, the customer agrees to pay all taxes due on the importation of the products, including customs duties, sales tax, and value-added tax, in accordance with the laws of the country of delivery.
The Customer may also choose to pick up the order at our warehouse, located at 4 rue Arthur Rozier and open Monday through Saturday by prior appointment. The order will be available within 24 hours.
Given the nature of the products sold by Les Tapis Sauvages, the company reserves the right to deliver to customers in the Paris region using its own means and will arrange a delivery appointment at a date and time that best suits the Customer.
4. PRICE
The price is expressed in euros. The price indicated on the product pages does not include shipping.
The price indicated in the order confirmation is the final price, inclusive of all taxes and VAT for France and EU countries. This price includes the price of the products, handling, packaging and storage costs, shipping and setup costs.
The prices shown on the product pages of the online catalog are in Euros (€) inclusive of VAT. No additional taxes will be required when placing the order, excluding delivery charges.
5. RIGHT OF WITHDRAWAL
Pursuant to Article L121-20 of the French Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and return the product to the seller for exchange or refund without penalty. Return shipping costs remain the responsibility of the buyer.
Les Tapis Sauvages does not accept exchanges. In case of cancellation, the order will be fully refunded, and a new order must be placed on the website www.lestapissauvages.com.
6. PAYMENT
All payment methods available to the Customer can be selected at the time of placing the order:
> By Credit Card via the secure Stripe payment software (encrypted and secure SSL software)
> By PayPal
> By check
> By bank transfer
For orders paid by bank transfer or check, orders will only be shipped upon receipt of firm and final payment. The 24-hour shipping time does not apply to these payment methods.
7 CUSTOM ORDERS
Les Tapis Sauvages offers a custom rug service. We can create the rug of your choice from our catalog in the dimensions that suit you. This service is free of charge. The production time and sales conditions will be specified in a quote sent before production begins. This quote will include the price, shipping costs, and production time. No deposit is required upon acceptance of the quote. Once the rug is manufactured and received in Paris, we will send you photos of the rug for your approval. You can then proceed with payment before shipment. No refunds will be issued for custom-ordered rugs, except in the case of a major defect. You may return the rug at your own expense, and we will issue a credit note valid for one year for the value of the rug (excluding shipping costs)
8. DISPUTES
This contract is governed by French law. Les Tapis Sauvages cannot be held liable for damages of any kind, whether material, immaterial, or physical, that may result from the malfunction or misuse of the products sold. In any event, the liability of Les Tapis Sauvages will not be limited to the amount of the order. In the event of difficulties in the application of this contract, the buyer has the option, before taking any legal action, to seek an amicable solution.
Failing an amicable agreement, the Commercial Courts of Paris shall have exclusive jurisdiction to resolve disputes of any kind.
9. WARRANTY
The liability of Les Tapis Sauvages is systematically limited to the value of the product in question at the time of sale, without recourse against the brand or the company that manufactured the product.
In any event, the customer benefits from the legal guarantee against hidden defects (Article 1625 et seq. of the French Civil Code). Provided the buyer proves the existence of a hidden defect, the seller is legally obligated to remedy all its consequences (Articles 1641 et seq. of the French Civil Code). If the buyer takes legal action, they must do so within a "short period" of discovering the hidden defect (Article 1648 of the French Civil Code).
